Distance Sales Contract

This Distance Sales Contract is concluded electronically between the seller identified above and the buyer whose name, contact, billing and delivery information is entered at checkout. The product, quantity, price, taxes, delivery charge, payment method and delivery information shown in the cart, checkout and order confirmation are an integral part of this contract.

The contract governs the sale and delivery of the selected goods and the parties' rights and obligations under applicable Turkish consumer and distance-sales legislation. The buyer confirms that the pre-information form and product-specific information were provided before placing the order.

The total price payable, including applicable taxes and disclosed delivery or other charges, is the amount confirmed at checkout. Payment is processed using the selected method through the authorised payment infrastructure. The order is accepted after successful payment authorisation and an electronic order confirmation is issued.

If performance becomes objectively impossible, the seller informs the buyer in writing or through a durable medium within three days after learning of it and refunds all payments, including delivery costs, within 14 days after that notice. A product merely being out of stock is not treated as objective impossibility; in that case the seller contacts the buyer and may provide an accepted alternative, an accepted later delivery or a full refund in accordance with mandatory law.

In-stock products are prepared for dispatch within 3–7 business days. Preparation times for made-to-order products vary and are stated on the relevant product page. UPS and Yurtiçi Kargo are the carriers currently used by Garaia. Estimated transit after dispatch is 2–5 business days within Türkiye and 5–10 business days internationally. These periods are estimates and may be affected by remote-area service, public holidays, customs, force majeure or carrier disruption.

Goods are delivered to the address and person selected by the buyer. Unless a longer period is expressly agreed for goods prepared to the consumer's specifications or personal needs, delivery does not exceed the statutory maximum period. The seller is responsible for loss and damage until delivery to the buyer or the designated third party, except where the buyer independently selects a carrier not offered by the seller.

Where the statutory right applies, the consumer may withdraw within 14 days without giving a reason. For goods, the period generally begins when the consumer or the designated third party receives the goods. The notice must be sent before expiry to info@garaiastudio.com or through another durable method offered by the seller. Unless the seller offers collection, the consumer sends the goods back within 14 days after notice.

The current approved domestic return route is Yurtiçi Kargo with pickup at its Osmanbey Branch; the buyer must request written shipping instructions before dispatch. For an ordinary withdrawal, the customer bears the return cost only if the designated carrier, exact return amount not exceeding the original delivery cost, and allocation of that cost were disclosed before the order. Otherwise, and for defective, damaged or incorrectly supplied goods, the seller bears the return cost. The seller refunds all sums required by law, including the standard outbound delivery cost, within 14 days after the product is handed to the designated carrier, using the original payment method without imposing a fee.

No withdrawal right exists where a statutory exception applies, including goods made to the consumer's specifications or clearly personalised, rapidly deteriorating goods, and sealed goods unsuitable for return for health or hygiene reasons once unsealed. Any relevant exception is identified on the product page or in the pre-information before purchase.

The seller is responsible for supplying goods in conformity with the contract. The consumer's mandatory remedies for defective goods, including repair, replacement, price reduction or termination where the legal conditions are met, are unaffected by this contract. Nothing in this contract excludes or limits liability that cannot legally be excluded or limited.

Complaints may first be sent to info@garaiastudio.com. Consumers may also apply to the competent Consumer Arbitration Committee or Consumer Court in accordance with the current monetary and territorial rules. Electronic store, payment, order and communication records may be used as evidence to the extent permitted by law.

By placing an order through the button that clearly indicates a payment obligation, the buyer confirms the pre-information and accepts this contract electronically. A copy is made available through the store and/or order confirmation. Mandatory consumer law prevails over any conflicting term.
